The Legal Position

Section 60I Family Law Act requires a genuine attempt at Family Dispute Resolution (FDR) before a court application in most parenting cases. Exceptions include family violence, urgency, and child welfare concerns. A Section 60I certificate from an accredited FDR practitioner is required to file.
