Australian Family Law — General Information

Can I contact my ex about the kids if there's an IVO?

Short Answer

Only if the intervention order specifically allows communication. Contacting your ex in any way that is not permitted is a criminal offence.

The Legal Position

The conditions of the intervention order determine what contact is permitted. If the order says no contact, that includes text messages and emails even about children. The order can be varied by the Magistrates' Court. Until it is varied, any contact not permitted is a breach.

  • s 123 Family Violence Protection Act 2008 (Vic) — breach offence
