Australian Family Law — General Information

Can I see my kids with an intervention order in Victoria?

Short Answer

Sometimes yes, depending on the conditions of the intervention order and whether there are parenting orders. Getting this wrong can lead to criminal charges.

The Legal Position

Intervention orders in Victoria are made under the Family Violence Protection Act 2008 (Vic). An intervention order does not automatically stop you seeing your children — it depends on the exact wording and whether children are listed. Family Court parenting orders can override inconsistent intervention order conditions under s 68R. Breaching an intervention order is a criminal offence under s 123 FVPA.
