Australian Family Law — General Information

How do I get more time with my child?

Short Answer

You can try mediation first, and if that fails, apply to the court to change parenting arrangements. The court will look at the child's best interests and what arrangement is practical and safe.

The Legal Position

Family Dispute Resolution (mediation) is required under s 60I before applying to court except in cases of urgency or family violence. The court determines arrangements based on best interests under s 60CA and s 60CC. A change to existing orders requires a material change in circumstances.

  • s 60I Family Law Act 1975 (Cth) — mediation requirement
  • s 60CA Family Law Act 1975 (Cth)
  • s 60CC Family Law Act 1975 (Cth)
