Australian Family Law — General Information

What happens if my ex breaches parenting orders?

Short Answer

Breaching parenting orders is a serious matter that can lead to court proceedings, makeup time, fines, or in serious cases changes to parenting arrangements.

The Legal Position

If the other parent is not complying with parenting orders, this can be raised with the court. The court considers whether the breach was intentional and whether there was a reasonable excuse. If you are not seeing your child despite having orders, get advice before taking further steps.
